The following constitutes the Terms & Conditions of Service for use of the MooseCreekTraders.com website and its associated services. No warranty or promise made, either in writing or verbally, shall supercede, negate, or replace the terms as set forth herein. Nature of merchandise being offered for sale - All items offered for sale on the Moose Creek Traders website shall include a prominent notice of merchandise condition. Most of the merchandise offered is brand new and comes directly from manufacturers or distributors with whom Moose Creek Traders has commercial relationships. These items will display a condition of "new". Moose Creek Traders also purchases large shipments of liquidated retail merchandise from national companies such as CVS, Wal Mart, Target, and others. When selling such merchandise, it shall show one of two conditions - "shelf-pull" and "new overstock". Shelf-pulled merchandise has been offered for sale on store shelves, but has never been in the hands of consumers. It still may show some signs of wear and tear to the packaging from handling but is still new and saleable. New overstock merchandise is inventory the retailers have purchased but never offered for sale, although it may also show some signs of packaging wear due to handling.
Merchandise is sold in "as is" condition - Merchandise sold by Moose Creek Traders is sold "as-is". When selling liquidated merchandise we do our best to sort everything to remove items that are broken, have spilled/leaked, or are missing parts or pieces prior to offering them for sale. It is always possible that an item in such condition may still be included in a customer shipment, and in such instances we refer to our return policy as stated below. Outside of such limited circumstances, all merchandise is sold in "as-is" condition, meaning Moose Creek Traders makes no guarantee, implied or express, as to the saleability or operational condition of items offered for sale.
Sale of damaged merchandise - Moose Creek Traders will, on a regular basis, offer special shipments of merchandise which shows an above-average degree of damage to its packaging than would normally be expected from "shelf-pulled" or "new overstock" items. These shipments will provide a clear and complete explanation of their condition, and it is the responsibility of the customer to read and understand the nature of the shipment's condition prior to purchasing it. Moose Creek Traders assumes no responsibility or liability for any issues arising from or connected with the purchase of these special damaged merchandise shipments
Payment for purchases - Payment for purchases must be made prior to shipment, except in such cases where a customer has been approved for a net terms account, in which case the purchase total may not exceed the available unused portion of the approved tradeline.

Shipment of orders - Moose Creek Traders will ship all orders placed within 72 hours following a completed purchase. Moose Creek Traders shall not be liable for any order which is delivered to an incorrect customer-provided address. Customers will receive tracking information for their orders as soon as it becomes available, and can view their order history at any time via the "My Account" link at the top of any page on the company web site.
Sales tax - Moose Creek Traders shall collect Colorado sales tax on all orders placed by customers.
